“Cooperation between medical examiner and procurement organization”
What it means
A medical examiner and a procurement organization must cooperate with each other to maximize opportunities to recover anatomical gifts for transplantation, therapy, research, or education.
The Florida Medical Examiners Commission must adopt rules establishing cooperative responsibilities between medical examiners and procurement organizations. The rules are meant to facilitate and expedite completion of the medical examiner's responsibilities under chapter 406 in a way that maximizes opportunities to recover anatomical gifts.
The section does not supersede any part of chapter 406 relating to medical examiners and the disposition of dead bodies.

Text of the statute (2026)
(1) A medical examiner and procurement organization shall cooperate with each other in order to maximize opportunities to recover anatomical gifts for the purpose of transplantation, therapy, research, or education.
(2) The Florida Medical Examiners Commission shall adopt rules establishing cooperative responsibilities between medical examiners and procurement organizations to facilitate and expedite completion of the medical examiner’s responsibilities under chapter 406 in a manner that will maximize opportunities to recover anatomical gifts.
(3) This part does not supersede any part of chapter 406 relating to medical examiners and the disposition of dead bodies.

How it applies
This section applies where a death falls under a medical examiner's responsibilities and an anatomical gift may be recovered. Both sides must cooperate, and the Medical Examiners Commission's rules divide their responsibilities.
Subsection (3) states that chapter 406 is not superseded, so responsibilities under chapter 406 relating to medical examiners and the disposition of dead bodies continue. The section on corneal removal during a required autopsy is s. 765.5185.
